Organisational Rules issued under Articles 23 and 24 of the Act of 15 April 2011 on Medical Activity (ustawa z dnia 15 kwietnia 2011 r. o działalności leczniczej) by the Management Board of QMEDIC sp. z o.o..

§ 1. Healthcare provider

The healthcare provider is QMEDIC SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Libertów, ul. Szlachecka 19, 30-444 Libertów, KRS 0001226410, NIP 9442300011, REGON 544080503, a healthcare provider entered in the Polish register of entities performing medical activity (RPWDL) under register book number 000000307083 (the "Provider").

The Provider provides healthcare services under the HelpDoc brand, through the helpdoc.pl service (the "Service").

§ 2. Objectives and tasks

The objective of the Provider is to provide healthcare services remotely, giving patients quick access to medical advice and continuation of treatment. The tasks of the Provider include in particular:

  • providing general and specialist medical advice in the form of teleconsultations (video, telephone, chat);
  • assessing orders for medicines and issuing e-prescriptions;
  • keeping medical records and making them available;
  • health education of patients.

§ 3. Type of activity and scope of services

The Provider performs medical activity of the outpatient healthcare services type, provided exclusively remotely by means of ICT systems or communication systems.

The services are paid for. The Provider does not provide services financed from public funds.

§ 4. Place where services are provided

Services are provided through the Service. The address of the medical establishment is the address of the Provider's registered office: ul. Szlachecka 19, 30-444 Libertów. Patients are not received at this location.

Orders and bookings are accepted in the Service 24 hours a day. Consultations take place at the times made available in the physicians' calendars.

§ 5. Organisational structure and management

  • The company is managed by the Management Board. The head of the healthcare provider is an experienced physician appointed by the Management Board, who is responsible for the organisation and quality of the services provided.
  • Services are provided by physicians holding the right to practise the profession, employed under an employment contract or a civil-law contract. In their medical decisions, physicians are independent and are bound only by the law and the principles of medical knowledge.
  • Administrative and technical support and contact with patients are provided by non-medical staff authorised to process data to the extent necessary to perform their duties.
  • Due to its size, the Provider does not establish organisational units or cells. The head of the provider directly supervises the work of the physicians and staff.

§ 6. Course of the process of providing services

  • The patient creates an account in the Service and, when placing an order, provides the data required for identification and record keeping: first name, surname, PESEL or identity document number, date of birth and address.
  • When ordering an e-prescription, the patient completes a medical questionnaire. The questionnaire puts the order on hold when the answers indicate the need for an in-person consultation.
  • The physician assesses the questionnaire and the patient's records. In case of doubt, the physician contacts the patient or recommends a teleconsultation or an in-person visit.
  • During a consultation, the physician takes a medical history, provides information on the state of health and recommendations and, where justified, issues an e-prescription.
  • E-prescriptions are issued in the P1 system. The patient receives the prescription code and PIN by SMS and e-mail.
  • If the patient's condition requires a physical examination or urgent help, the physician refers the patient to an appropriate facility, and where life is at risk, indicates the emergency number 112.
  • Every service is documented in the electronic medical records.

§ 7. Cooperation with other entities

The Provider cooperates with other entities to the extent that ensures correct diagnosis, treatment and continuity of care, in particular:

  • with Centrum e-Zdrowia (e-Health Centre), through the P1 system (e-prescription, medical events, Internetowe Konto Pacjenta (Online Patient Account));
  • with pharmacies dispensing the prescriptions issued;
  • with the provider of the MedFile electronic medical records system;
  • with other healthcare providers to which it refers patients requiring in-person services.

§ 8. Medical records

The Provider keeps medical records in electronic form and retains them for the periods specified in Article 29 of the Act on Patient Rights and the Patient Ombudsman (ustawa o prawach pacjenta i Rzeczniku Praw Pacjenta).

Records are made available to the patient, the patient's statutory representative or a person authorised by the patient, upon a request submitted to [email protected] or by post. They are made available without undue delay, in electronic form, as a copy or as a printout.

Making medical records available is free of charge.

§ 9. Fees for services

The fees for services are set out in the price list shown in the Service for each service: the price of an e-prescription next to the selected medicine, the price of a consultation next to the selected physician, together with the express fee if the patient selects it. The patient knows the full amount before placing the order.

The rules on payments, refunds and complaints are set out in the Terms of Service of the Service.

The fee for an e-prescription order is a fee for a medical consultation with the possibility of issuing an e-prescription and is due regardless of whether the physician issues a prescription.

§ 10. Patient rights and complaints

Information on patient rights is available in the Service on the Patient Rights page. Patients submit complaints and requests to [email protected]. The head of the provider considers them within 6 working days.

§ 11. Final provisions

The Organisational Rules are adopted and amended by the Management Board. The Rules are made available in the Service, and the Provider's staff confirm that they have read them.
